In a recent ruling, the Supreme Court of India reiterated the critical importance of uninterrupted services in the fields of justice and medicine. The court emphasized that professionals in these sectors cannot afford to go on strike, as their work involves matters of life and liberty. This statement was made during a hearing related to the tragic rape and killing of a post-graduate medic at Kolkata’s RG Kar Medical College and Hospital.

The Supreme Court bench, headed by Chief Justice D Y Chandrachud, addressed the ongoing strike by doctors protesting the incident, urging them to return to work. The bench underscored that both judges and doctors hold responsibilities that cannot be paused. The court expressed concern over the absence of protesting doctors, particularly those from the All India Institute of Medical Sciences (AIIMS) in Nagpur, who are being marked absent and denied examination opportunities due to their participation in the strike.

The bench clarified that while they cannot instruct the administration to mark absent doctors as present, they would recommend a lenient approach if the doctors resume their duties promptly. The court’s appeal was directed at ensuring that marginalized and needy patients do not suffer due to the absence of medical professionals.

The court also assured the doctors that no coercive actions would be taken against them for protests conducted prior to the court’s latest order, provided they return to work immediately. This assurance came after the Delhi Medical Association informed the court about FIRs filed against AIIMS doctors involved in the protests.

This strike has persisted for 13 days, with the Supreme Court previously appealing to the doctors to return to their duties, emphasizing the national importance of their safety and protection. The court took up this matter, highlighting that it transcends a single serious offense and impacts the entire healthcare system across India.

The case centers on the horrifying rape and murder of a junior doctor in a seminar hall at the RG Kar Medical College. Her body, bearing severe injuries, was discovered on the morning of August 9. A civic volunteer of the Kolkata Police was arrested the following day, with the case being transferred from the Kolkata Police to the Central Bureau of Investigation (CBI) by the Calcutta High Court.

The Supreme Court’s directive comes as a crucial reminder of the indispensable role doctors play in society and the need for their continuous service, especially in times of crisis.
