Emergency Movie Certification Delayed by Court

The Bombay High Court has refused to direct the Central Board of Film Certification (CBFC) to issue an immediate certificate for the Kangana Ranaut-directed film ‘Emergency.’ This decision comes amid ongoing controversies and objections raised by Sikh organizations regarding the film’s portrayal of historical facts.

The movie, based on the life of former Prime Minister Indira Gandhi, was initially scheduled to release on September 6. However, it has faced delays after Sikh groups voiced concerns over the portrayal of Sikhs in the film. The High Court stated that it would not pass any directive to the CBFC due to an existing order from the Madhya Pradesh High Court, which instructed the CBFC to address the concerns raised by the Jabalpur Sikh Sangat.

A two-judge bench, while hearing the plea filed by co-producer Zee Studios, emphasized that the CBFC must consider objections before issuing any certificate. “Judicial propriety demands such orders ought not be passed. We therefore, are unable to direct the CBFC to issue the certificate as sought by the petitioner,” the court remarked.

The court acknowledged the financial implications of film production, highlighting that significant investments are at stake. It also criticized the CBFC for citing the Ganpati festival as a reason for delaying the certification process. Kangana Ranaut’s team expressed their frustration via social media, criticizing the CBFC’s handling of the certification.

This legal standoff follows a petition filed by the Jabalpur Sikh Sangat and Sri Guru Singh Sabha, who argued that specific scenes in the movie violated the Sikh community’s rights. They demanded an apology from Kangana Ranaut and asked the CBFC to reconsider the film’s approval.

In addition, the Shiromani Akali Dal has also legally challenged the film, insisting that the CBFC halt the release until the concerns of the Sikh community are addressed. The case continues as the CBFC reviews all objections, with the next decision expected by September 18.
