What Was the Urgency? Court Questions Bengal Over Demolition Near Crime Scene
The Calcutta High Court is scrutinizing the West Bengal government’s decision to demolish parts of RG Kar Medical College and Hospital near the crime scene where a trainee doctor was brutally raped and murdered. This development has sparked significant concern and debate about the timing and necessity of the demolition work.
Court Orders Government to Explain
On Friday, the court demanded an explanation from the Mamata Banerjee-led government regarding the “urgent” demolition work carried out around the seminar hall in the emergency building of the hospital. This area is linked to the horrific crime, raising suspicions that the demolition could have been intended to destroy crucial evidence.
The state government’s legal team responded by asserting that the demolition was for the construction of a new restroom for doctors. They refuted claims that the crime scene was compromised. According to Bar and Bench, the government’s counsel stated, “All these allegations that the place of occurrence of the crime has been demolished are incorrect. The demolition work did not occur near the actual crime scene.”
Chief Justice Questions Timing
Chief Justice TS Sivagnanam expressed skepticism about the urgency of the renovation work. During the hearing, he questioned why a restroom needed to be constructed within such a short timeframe. “Is it so important to provide a restroom within 12 hours to meet urgency? You go to any district court complex, see if ladies have any restrooms,” he remarked, highlighting the broader issue of inadequate facilities in public institutions.
The court also criticized the government’s handling of the situation, labeling it an “absolute failure” of state machinery. The Chief Justice pointed out the lack of control and oversight during the incident, which led to significant vandalism at the hospital on August 15.
Vandalism and Investigation
On the eve of Independence Day, a violent mob attacked RG Kar Hospital, causing extensive damage to several wards. Despite police assurances that the crime scene on the third floor remained untouched, the High Court demanded proof of this claim. The court ordered the government to file an affidavit, complete with photographic evidence, to confirm that the crime scene was preserved.
Next Steps
The court has scheduled the next hearing for August 21, where it will review the state’s affidavit and evidence. If the government fails to provide satisfactory proof, it may face further scrutiny and potential legal consequences.
The case has drawn widespread attention, highlighting serious concerns about the integrity of the investigation and the handling of sensitive crime scenes. As the situation unfolds, the public and legal community will be watching closely to ensure justice is served.
