The Calcutta High Court strongly criticized the West Bengal government for its inability to prevent the recent mob attack and vandalism at RG Kar Medical College and Hospital in Kolkata. During a hearing on Friday, the Chief Justice labeled the situation as a complete “failure of state machinery,” condemning the government’s lack of action in safeguarding the medical institution and its personnel.
The incident in question occurred on the eve of Independence Day, amidst the nationwide ‘Reclaim the Night’ protest, leading to significant unrest and damage at the hospital premises. The Chief Justice of the Calcutta High Court expressed deep concern over the state’s handling of the situation, stating that the city police failed to protect themselves, raising doubts about how doctors and medical staff could work fearlessly in such an environment.
In the court’s words, this event is a clear indication of the “sorry state of affairs” in the region, pointing out that the authorities were unable to enforce law and order effectively. The court’s decision to take up the case was prompted by multiple emails and reports regarding the vandalism and mob attacks at the hospital, signaling widespread concern among citizens.
The Chief Justice reprimanded the state for not implementing adequate measures, such as imposing Section 144 of the Code of Criminal Procedure (CrPC), which restricts public gatherings in situations of potential unrest. “When so much commotion was going on, you should have cordoned off the area,” the Chief Justice remarked, highlighting the state’s failure to control the situation.
Moreover, the court questioned the feasibility of a mob of 7,000 people moving unchecked, suggesting that preventive measures could have been taken to avoid the escalation of violence. This criticism underscores the court’s dissatisfaction with the state’s response and emphasizes the need for stronger governance and law enforcement in West Bengal.
