The Karnataka High Court paused the investigation against Union Minister Nirmala Sitharaman and other BJP leaders related to the electoral bond extortion case on Monday. The court ruled that there was no direct threat against the complainant.
The court emphasized that under Section 286 of the Bharatiya Nyaya Sanhita (BNS), certain key elements must be present for an extortion case, including a direct threat and a complaint from the affected person.
Furthermore, the court observed that no such threat was made against the complainant, and the magistrate’s order did not address the specifics of extortion. The interim order from the court stays the investigation until the next hearing scheduled for October 22. This decision brings relief to Nirmala Sitharaman, who has been facing allegations in this matter.
Thus, the Karnataka High Court clarified that proceeding with any investigation without considering all significant aspects would be inappropriate. This case will now be prepared for the next hearing, allowing all parties a chance to clarify their positions.
