A two-judge bench of the Delhi High Court, consisting of Acting Chief Justice Manmohan and Justice Tushar Rao Gedela, decided to transfer the case to the CBI. The judges stated, “Having regard to the nature of the incident, and to ensure that public has no doubt with regard to the investigation, this court transfers the investigation to the CBI.”

The judges expressed their frustration with the MCD’s apparent negligence, stating, “Mercifully, you have not challaned rainwater for entering into basement, the way you arrested the SUV driver for driving his car there.”
