A Danish court has rejected India’s request for the extradition of Kim Davy, the alleged mastermind behind the Purulia arms drop case. This decision, made on Thursday, is rooted in concerns that sending Davy to India would violate Denmark’s extradition act due to potential human rights violations.
Kim Davy, also known as Niels Holck, is wanted by India for his involvement in the controversial arms drop incident on December 17, 1995. An Antonov An-26 aircraft, piloted by a crew led by Peter Bleach, dropped a large cache of weapons over Joupur village in West Bengal’s Purulia district. The arms, which included AK-47 rifles, grenades, and ammunition, were reportedly intended for the Ananda Marga group, a socio-spiritual organization with a militant history.
India has long sought Davy’s extradition to stand trial, but the Danish court ruled that his return would contravene the European Convention on Human Rights. Danish public prosecutor Anders Rechendorff indicated that the possibility of an appeal is still under consideration.
Davy’s lawyer, Jonas Christoffersen, argued that the guarantees provided by India were insufficient, raising concerns about Davy’s safety. Christoffersen stated, “The court has determined that Davy’s safety cannot be assured, despite six years of negotiations.”
In a Danish court, Davy admitted to being aboard the plane with six others, involved in smuggling arms to West Bengal. He also confessed that the arms were meant for members of Ananda Marga, countering claims that the drop was intended to support the rebel group against the West Bengal government.
The Purulia arms drop case has been marked by controversy and speculation. Some theories suggest Davy had CIA connections and that his protection by Danish authorities might be linked to his alleged role as a ‘dirty asset’ for the CIA. Both Davy and Bleach have claimed that Indian authorities were aware of the arms drop plan, aimed at destabilizing the communist rule in Bengal.
