West Bengal has taken a historic step towards stricter punishment for rape and sexual offences by passing the ‘Aparajita’ anti-rape bill. This landmark legislation, introduced by the Mamata Banerjee government, was unanimously passed by the West Bengal Assembly and is set to become the most stringent anti-rape law in the country.
Historic Step Against Rape
The Aparajita bill, formally known as the ‘Aparajita Woman and Child Bill (West Bengal Criminal Laws and Amendment) 2024,’ proposes the death penalty for convicted rapists whose actions result in the death of the victim or leave her in a vegetative state. This makes West Bengal the first state to amend central laws specifically addressing offences of rape, gang-rape, and sexual crimes against children.
Mamata Banerjee’s Strong Stand
Chief Minister Mamata Banerjee called the bill a tribute to the 31-year-old trainee doctor who was brutally raped and murdered at RG Kar Medical Centre and Hospital last month. Banerjee emphasized that the bill aims to close legal loopholes and provide stricter punishment for sexual offenders. “Rape is a curse against humanity, and social reforms are necessary to curb such crimes,” she stated, urging the opposition to support the bill’s swift enactment.
Provisions of the Aparajita Bill
Apart from the death penalty, the bill also includes life imprisonment without parole for convicted rapists. It seeks to create a legal framework where offenders face severe consequences, ensuring justice for victims and acting as a deterrent to potential offenders.
Political Reactions
The bill’s passage sparked heated discussions in the assembly, with the BJP opposing certain aspects but ultimately supporting the overall intent. Opposition leader Suvendu Adhikari proposed seven amendments, emphasizing the need for immediate implementation of the law. He affirmed, “We support the bill, but we need immediate action and results. The state government must ensure that the bill is implemented without delay.”
Governor and Presidential Assent Needed
The bill will now be sent to West Bengal Governor CV Ananda Bose and President Droupadi Murmu for their assent. Mamata Banerjee urged the Governor to expedite the approval process, highlighting the urgency of enacting the law to deliver justice to victims swiftly.
Comparison with Central Laws
While the BJP welcomed the state’s efforts, they pointed out that the Bhartiya Nyay Sanhita (BNS) already contains stringent provisions for dealing with crimes against women and children. However, Mamata Banerjee argued that Bengal’s legislation is a model for other states to follow, emphasizing that regional governments must address local issues more effectively.

Mamata Banerjee’s government has been vocal about the need for broader social reforms to reduce crimes against women. The Chief Minister highlighted the importance of both legal changes and societal shifts to ensure a safer environment for women in West Bengal and across India.
