Karnataka High Court Judge Rebukes Rs 6 Lakh Maintenance Claim
On August 20, a Karnataka High Court judge sharply criticized a woman’s demand for Rs 6,16,300 in monthly maintenance from her husband. Radha Munukuntla, the petitioner, sought financial support under Section 24 of the Hindu Marriage Act, 1955, presenting detailed expenses to justify her claim.
Munukuntla’s lawyer argued that the woman needed Rs 15,000 monthly for personal items like shoes and dresses, Rs 60,000 for home food, and Rs 4-5 lakh for medical treatments including physiotherapy. This totalled Rs 6,16,300 per month.
The judge questioned the legitimacy of such a high amount, stating, “Rs 6,16,300 per month! Does anyone spend that much? A single lady for herself. If she wants to spend, let her earn. Not on the husband.” The judge emphasized that Section 24 of the Hindu Marriage Act was not intended to punish the husband but to provide reasonable support.
She further instructed the lawyer to propose a more sensible amount, warning that unreasonable demands could lead to dismissal of the plea. A video of the judge’s remarks has since gone viral, highlighting the court’s stance against excessive maintenance claims.
Under Section 24 of the Hindu Marriage Act, 1955, spouses involved in legal disputes may receive interim maintenance if they lack sufficient independent income. This provision aims to ensure fair support during ongoing proceedings.
