The Central Bureau of Investigation (CBI) has warned the Supreme Court that granting bail to Delhi Chief Minister Arvind Kejriwal, currently under arrest in the liquor policy case, could potentially demoralise the Delhi High Court. The statement was made by Additional Solicitor General (ASG) SV Raju, representing the CBI, during a hearing where Kejriwal sought bail and challenged his arrest by the CBI.
During the hearing, Raju emphasized, “If bail is granted today, it will demoralise the High Court.” This remark was made during Kejriwal’s plea challenging his arrest and seeking bail in the ongoing case related to the Delhi liquor policy. Previously, the Delhi High Court had denied him any relief.
However, the Supreme Court justices were not receptive to Raju’s argument. Justice Ujjal Bhuyan, one of the judges on the two-judge bench, responded sharply, stating, “Do not say all that. It cannot be a submission of any lawyer.” Justice Surya Kant added that the court would ensure that nothing like that happens while pronouncing the verdict.
Raju defended his statement by pointing out that the High Court had not considered the matter on its merits. He further questioned whether Kejriwal could request bail without submitting a copy of the chargesheet, highlighting its importance as it details Kejriwal’s role in the case.
The Aam Aadmi Party (AAP) chief was arrested on June 26 by the CBI, days before he was granted interim bail in a related case involving the Enforcement Directorate (ED). Unusually, Kejriwal bypassed the trial court and directly approached the High Court for bail while also seeking to quash his CBI arrest.
The High Court upheld his arrest but directed him to approach the trial court for bail, prompting Kejriwal to take his case to the Supreme Court. The Supreme Court has reserved its verdict on his bail plea and arrest challenge, leaving the legal battle ongoing.
